Green Card Eligibility Categories
A green card allows a person to live and work permanently in the United States, but the appropriate application route depends on eligibility. USCIS recognizes categories based on family relationships, employment, special immigrant status, refugee or asylee status, and the Diversity Visa Program.
Other potential routes are available to certain T and U visa holders, VAWA self-petitioners, and people who qualify through Registry. VAWA refers to the Violence Against Women Act, which permits certain abused spouses, children, and parents to seek immigration status without relying on the abusive relative to file for them. Registry is a limited provision for certain people who have continuously resided in the country since before a date established by federal law.
Immediate Relatives & Family Preference Categories
USCIS separates qualifying relationships into immediate-relative and family-preference classifications. Immediate-relative classifications cover certain close relatives of U.S. citizens. The preference classifications apply to other relationships and are subject to annual visa limits.
The family preference categories include:
- F1: Unmarried sons and daughters age 21 or older of citizens
- F2A: Spouses and unmarried children under 21 of green card holders
- F2B: Unmarried sons and daughters age 21 or older of green card holders
- F3: Married sons and daughters of citizens
- F4: Siblings of citizens who are age 21 or older
Applicants in these preference categories who seek adjustment of status generally must have been inspected and admitted or inspected and paroled into the United States. Limited exceptions may apply, so entry history and current immigration status require careful review before filing.
Two Paths to a Green Card
There are two principal ways to pursue a green card after establishing an eligible basis. Applicants already in the United States may qualify to file Form I-485 to adjust their status. Consular processing applies to applicants abroad after USCIS approves the underlying petition.
Both paths involve a petition, supporting documentation, a biometrics appointment, and, in most cases, an interview. A petition based on a qualifying relative commonly begins with Form I-130, Petition for Alien Relative. The exact evidence and sequence depend on the relationship, the applicant’s location, visa availability, and any immigration or criminal history.
International Travel While an Application Is Pending
Leaving the country while an adjustment application is pending without approved advance parole may be treated as abandonment. Advance parole authorizes an applicant to return after temporary international travel. Applicants should assess the immigration consequences before making travel plans.
Processing duration varies by eligibility category, application path, visa availability, and case-specific requirements. Rather than applying a single timeline to every applicant, we focus on the filings and procedural steps relevant to each case.
Direct Green Card Representation for Coral Gables Clients
Attorney Juliana G. Lamardo has more than 10 years of legal experience and personally navigated the U.S. immigration system before becoming a U.S. citizen. That firsthand experience informs our representation of people pursuing permanent residence through a system shaped by detailed documentation and changing policies.
Clients work directly with Attorney Lamardo from the first conversation through the conclusion of their case. She has represented clients before USCIS and Immigration Court in petitions for qualifying relatives, residency applications, and cases involving criminal records.
Our prior work includes obtaining residency for a client after an I-130 petition had been denied twice based on allegations of marital fraud. Past results don’t predict the outcome of another case, but this result reflects our experience addressing disputed petitions and complex immigration records.

"She is amazing!!"They say marriage interviews you are to be afraid of - but with Ms. Lamardo, that is out the door. Juliana helped us get all together, talked to us, gave us a preview and we felt way more confident. The day arrived and it was so fun with her, we laughed, we met other attorneys, we even forgot that we had the interview. We went in, and everything went smoothly. It was great! She is amazing!! Of course before all that fun we had some serious time to prepare and get everything we needed and she helped us do that and her name is well known so we were good. I just want to say - Thank you very very much!- Luis
