Determining Eligibility for Citizenship
The first step in the naturalization process may be obvious, but it is critical – you need to find out if you are eligible to become a U.S. Citizen. Most people who qualify for citizenship have held a green card for a minimum of five years. A person who has been a green card holder for three consecutive years while being married to a U.S. Citizen can apply for naturalization.
If one of the above is true of you, there are several other requirements that you must meet to apply for Citizenship.
Additional requirements for naturalization include:
- Being 18 years or older at the time of filing
- Being able to read, write, and speak English
- Being a person of good moral character
- Passing a U.S. government and history test
- Living in the same state for at least three months before filing
- Residing physically in the U.S. for a minimum of 30 months out of your five years as a resident
Meeting these requirements means that you are eligible to apply for Citizenship. However, if you have any criminal convictions, tax problems, have not paid child support, or if you have traveled abroad extensively during your U.S. residency, this may adversely affect your application. It is highly recommended that you consult with an experienced immigration attorney prior to filing to discuss whether these issues could cause your request to be denied.
